MishMash Terms of Service

Welcome to MishMash: The Laboratory of Everything!

These Terms of Service ("Terms") govern your use of the MishMash mobile application ("App") provided by Appcific Technologies Pty Ltd ("we," "us," or "our").

By downloading, installing, or using MishMash, you agree to these Terms. If you are a parent or guardian allowing a child to use the App, you agree to these Terms on behalf of that child.

⚠️ Early Access Notice: MishMash is currently in early access (beta). While the app is available for download and purchase, we are actively building and hardening our systems. Please read Section 1A below before subscribing.

1A. Beta / Early Access Status

MishMash is currently offered in early access. This means:

• The service is live and functional, but our infrastructure, AI generation systems, and backend services are still being improved and made more resilient.
• Interruptions may occur. Features — including AI image generation — may be temporarily unavailable due to planned maintenance, third-party service outages (such as OpenAI), or unexpected issues as we scale the platform.
• Features may change. We may add, modify, remove, or temporarily disable features during the early access period without prior notice.
• Daily limits may be adjusted. Generation limits across all subscription tiers may be changed remotely to manage service stability (see Section 7).

What this means for subscribers

We appreciate your early support and take it seriously. If you are a paid subscriber and experience a meaningful service disruption:

• We encourage you to contact us at support@appcific.com — we will do our best to address your situation, which may include extending your subscription period at our discretion.
• Refund eligibility is governed by Apple App Store and Google Play policies (see Section 6).

By subscribing during early access, you acknowledge that you understand the service is still maturing and agree not to hold Appcific Technologies liable for interruptions that are typical of an early access product.

1. About MishMash

MishMash is a creative app designed for children ages 3-12. Users explore magical worlds (like Weather Station, Creature Creek, and Dino Dig), select ingredients, and "mix" them together to create unique AI-generated images of imaginary creatures.

2. Who Can Use MishMash

Age Requirements

• MishMash is designed for children ages 3-12
• Children under 13 should use the App with parental knowledge and supervision
• Parents and guardians may use the App alongside their children

Parental Responsibility

If you allow a child to use MishMash, you are responsible for:

• Supervising their use as appropriate for their age
• Reviewing our Privacy Policy
• Ensuring the App is used appropriately

3. Using MishMash

What You Can Do

• Create and save AI-generated creature images
• Explore different weather phenomena combinations
• Save creations to your device's local gallery
• Customize app appearance (themes)

What You Cannot Do

• Use the App for any illegal purpose
• Attempt to reverse engineer or modify the App
• Use automated systems to access the App
• Misrepresent your identity or age

4. Content and Creations

AI-Generated Images

• Images are generated by artificial intelligence (OpenAI)
• Each image is unique and created in real-time
• We do not pre-screen or manually review generated images
• Images are designed to be child-appropriate using safety filters

Your Creations

• Images you save are stored locally on your device
• You may use your saved images for personal, non-commercial purposes
• You may share images with family and friends
• We do not claim ownership of images you create

Content Safety

We use AI safety measures to ensure generated content is appropriate for children. However:

• AI systems are not perfect
• If you see inappropriate content, please contact us immediately at: support@appcific.com
• We will investigate and improve our safety measures

5. Accounts (Optional)

Basic Use

• No account is required to use MishMash's core features
• All creations are saved locally on your device

Optional Account Features

• If you create an account (future feature), you agree to provide accurate information
• Parents must create accounts on behalf of children under 13
• You are responsible for maintaining account security

6. Subscriptions and Purchases

Free Tier

• MishMash is free to download and use
• Free users can create a limited number of mixes per day in selected worlds
• There are no advertisements in the App

MishMash+ Subscription

• Pricing: Available as monthly or annual plans (prices may vary by region)
• Includes: Increased daily mix allowance, all 9 worlds unlocked, and higher quality AI-generated images
• Free trial: A 7-day free trial is available for new subscribers on both monthly and annual plans. After the 7-day free trial ends, your subscription will automatically renew at the applicable subscription price (monthly or annual). You will be charged through your App Store or Google Play account. Cancel anytime before the trial ends to avoid being charged.
• Auto-renewal: Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period. The subscription fee will be charged to your App Store or Google Play account.
• Cancellation: You can manage and cancel subscriptions at any time in your device's account settings (iOS: Settings > Apple ID > Subscriptions; Android: Google Play > Subscriptions)
• Early access: Subscriptions purchased during early access are subject to the service availability limitations described in Section 1A

MishMash VIP (Lifetime)

• Pricing: One-time purchase (see App for current pricing). This is not a subscription and does not auto-renew.
• Includes: All MishMash+ features, a generous daily mix allowance, best quality AI-generated images, VIP badge, priority support, and early access to new features

Parental Gate

• All purchases and app Settings are protected by a parental gate that requires adult interaction
• Children cannot make purchases or change settings without parental assistance

Refunds

• Refund requests are handled by Apple (App Store) or Google (Play Store) according to their respective refund policies

7. Daily Usage Limits

To encourage healthy screen time habits and ensure a high-quality experience:

• Each subscription tier includes a daily image generation allowance
• Higher tiers enjoy progressively more generous daily limits
• All limits reset each day
• We aim to provide large and generous limits across all tiers. Daily limits may be adjusted from time to time to reflect system performance, cost considerations, and overall service quality — without requiring an app update. Any significant changes will be communicated to users

8. Intellectual Property

Our Property

• The MishMash name, logo, and app design are our property
• The weather phenomena catalog and descriptions are our property
• The app code and infrastructure are our property

Third-Party Property

• AI image generation is powered by OpenAI
• Some device features use Expo and React Native frameworks
• These services are subject to their own terms

9. Disclaimer of Warranties

MishMash is provided "as is," "as available," and "in early access" without warranties of any kind, either express or implied.

We do not warrant that:

• The App will be uninterrupted or error-free
• AI-generated content will meet your expectations
• The App will be compatible with all devices
• The service will be available at any particular time, including for paid subscribers during the early access period
• Third-party services we rely on (including OpenAI image generation and RevenueCat subscription management) will be available or perform without interruption

10. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability is limited to the amount you paid for the App (if any)
• We are not responsible for content generated by AI systems

11. Changes to the App and Terms

App Updates

• We may update the App to add features, fix bugs, or improve performance
• Some updates may be required to continue using the App
• We will try to maintain backward compatibility where possible

Terms Updates

• We may modify these Terms at any time
• Significant changes will be communicated via in-app notice
• Continued use after changes constitutes acceptance

12. Termination

By You

• You may stop using MishMash at any time by uninstalling the App
• Uninstalling removes all locally stored data

By Us

• We may terminate or suspend access for violations of these Terms
• We may discontinue the App with reasonable notice

13. Governing Law

These Terms are governed by the laws of New South Wales, Australia, without regard to conflict of law principles.
